About 2 months ago I purchased an 01 WR426 that has been dual sported. It already has a CA plate on it with a valid sticker until 10/2003.

I went to the DMV today to transfer title, and after an hour, they said that because the bike was origially a red sticker bike, it should never have recieved a plate and I need to surrender mine.

Needless to say I am very, VERY pissed.

Has anyone ever brough a lawsuit against CARB? I am thinking of doing it. I mean ok, so I can get a green sticker, I guess that I will put my bike in the back of my Toyota V8 truck to drive it the 30 miles to where I want to ride. I am sure that the truck only puts out 5x the polution the bike does.

Man that sucks. But since the laws have changed and it's a '01, when you get off road registration you'll receive a green sticker. You should be able to get another plate after you refile the paperwork. Just have it done by late December/early January. I'm not sure what the exact cut-off date is, but it's posted on the Baja Designs website.

The DMV is such a pain in the ass. Aren't they aware that once you get your green sticker you can resubmit the paperwork and get another plate?

I've got a '02 CRF450 that I have been considering getting dualsported with dual registration before the cutoff date. I mostly ride track but I might want to have it dualsport ready sometime in the future.

That's a load of crap! Your bike is now green sticker eligible and is therefore eligible for a CA license plate. I'd go back, talk to the office manager, and refer to DMV memo VR2003-24a.

You could also try going to a different DMV office. I'm not saying they'll be any less stupid than the folks you talked to today, but you never know.

The California DMV likes to be it's own little entity!!!, try another office, (preferably one in a sparsley populated area), and see what happens???. :)

I went to 2 different DMV offices the CU!T at the first one put notes in their database next to the VIN stating that I need an OK from CARB (yea this will be fun)

I am soooo pissed :) :D :D

You so-cal boys got it rough. Up here you could get a plate for just about anything you want. Maybe its worth a drive???? :)

Its not bad enough that the rules suck, but the DMV screws people out of its employees stupidity/laziness/whatever.

&%$#@!? :excuseme:I thought the new rules allowed dual sporting of '02 and older bikes until 1/1/04.
I just bought insurance and kit in hopes of getting a plate early next week.
Man if I'm denied at the DMV I think I'll just sell both of my clean 4stks and get one big nasty 2 smoker,(cr 500 maybie)and throw violent roosts of protest. :)
I hope this is just a mistake.

CARB will probably OK it, sucks that you have to deal with it this way though, good luck

Garry, who ever you talked to has their head up their ass, download a copy of VR2003-24a and take it back to them, this is from CARB and it's the one that voids out the last lame ass memo they got, all DMVs should have it by now and all 02 and older bikes are green sticker, it doesn't matter a flying **** what it was before, it is green now and DS-able...............damn these freak'n people are stupid

I guess it was a red sticker bike. I just wrote Conway, Andrew M. [mailto:aconway@dmv.ca.gov], as he sent out an e-mail recently about this crap.

That's what i posted on Southwest rides(Gorman)! My friend who has a legal daulsport KTM! said that even he is going to have to cough up his plate! Even though greensticker, they are not made for the street!! That's what he told me!!!??????
Now seeing what is happening to Garry, only makes me believe it more!! :)

This came off the Ca. DMV website;

California Air Resources Board (ARB) established regulations to limit the use of Off-Highway Vehicles (OHVs) that do not meet emission standards applicable for California OHV riding areas. After the regulations were established, ARB and DMV worked together to develop criteria for identifying non-complying OHVs. OHVs are registered by the Department of Motor Vehicles (DMV). A red or green sticker is issued depending upon certain criteria.

Green stickers are issued for all California OHVs year model 2002 and older, including those that were previously issued a red sticker, and to 2003 and newer complying vehicles. Green stickers are issued to OHVs for year round use at all California OHV riding areas.

Red stickers are issued to 2003 year model and newer OHVs that are not certified to California OHV emission standards. If your OHV has a "3" or "C" in the eighth position of the vehicle identification number (VIN) then your vehicle will be issued a red sticker. Red stickers are issued to OHVs that can use California OHV riding areas for seasonal use only.


You are dealing with a total knothole, they need to read their own regulations

As for requesting your plates be surrendered, I can't really speak to that issue - I have no idea why they are requesting that. As you know, we have delayed our dual sport restrictions until January and even in that event, they do not apply to vehicles already registered for on highway use.

I would suggest that if there are any other problems when you reappear at DMV that they contact myself or Eric Bentzen here at the Revenue and Compliance Policy Section - bring this message to the counter if you like. Our number is (916) 657-5836. Admittedly, there has been a lot of confusion over this issue, and our newest memo on the subject (VR 2003-24a) may not be in everyone's hands.

California seeks the new restrictions to aid its fight against some of the nation's worst smog. Sen. Dianne Feinstein (news, bio, voting record) has said they would cut emissions by 50 tons a day, the equivalent of removing 1.8 million cars from the state's roads

Yup, CA DMV (Especially in the big cities where you get that big Fat-A$$ woman with a name like "Luticia" that gives you that,"Oh, your one of those!" look!) SUCKS! As in L.A. by the airport, when I needed a copy of my License! :D

I hope you take that e-mail and 2003-24A and "RAM IT DOWN!"
