I was confused for a second;) It boils down to choice. I would rather skip the tabs fees I would pay to WA and make another donation to the NMA lawsuit, that is just me. The law? Whatever, it would not be the first time I got a ticket or spent some time in a cell. My kids, well that is all up to perspective. Part of me would feel bad if my kids had to go though getting a ticket but they would know what it is like to stand up for their rights.
Joe...........

Well, in case you missed my previous posts, I've been doing something about it. Now, this is a sensitive issue on a public forum, so right off, I must say that this was my idea (or my fault) and NMA and WOHVA can not and will not endorse my decision.

I've had similar discussions with un-named USFS Rangers like Vsekvsek mentioned earlier about buying and checking ORV tabs. for myself, I have elected to NOT buy any more ORV TABS for my 3 bikes. But since I donated the cash, I wanted a way to show my support for the people out there managing our trails and counting the days when there will be no funds to keep them on staff.

I've been bugging NMA and WOHVA to produce a "Thank You Sticker" for the people that took the time and money to support the legal action. They informed me that it was difficult to find the time from the all-volunteer staff and Tod jokingly suggested that maybe I should do it, so I did!!

I took a photo of $20 bills in my clinched fist and a previous photo of the State Capitol building and sent them to a Photoshop friend with a preliminary design. He donated his time and cooked up a finished product. And as I type this, the 500 plus stickers are in the mail !!! LewisportUSA wanted to help out and gave us a ridiculously low price to make the stickers. My "photoshop friend" is the Son of a well known East Coast Trials Shop owner and donated his time as well. Everyone involved in making these stickers are people that ride and support off-road sports. And I'm proud to have been a part of it.

My idea for distributing these stickers, (and this may be modified by NMA and WOHVA) was to give one sticker to each person that donated $25 or more to the legal fund. In addition, I was hoping that they would give out one sticker for each $25 worth of donation up until the number of bikes you own is covered, which ever is less.

In my case, my $500 donation more than covers the three bikes I own, but I will receive only three stickers. In my way of thinking, these will replace the ORV TABS that I'm not going to buy this year. I'm going to use mine as a non-verbal way of showing any USFS or DNR person I come across on the trail that I support in $$$ our lost NOVA funds and the people that depend upon them, even though I may not have a current ORV TAB.

I had them made small enough to fit on the front fender of a Trials Bike and that is where I will display mine. I will not ask any USFS or DNR person to look the other way and if they choose to cite me for no ORV Tab, I will gladly accept the ticket and take it along with the history of the NOVA fund and the details of the State Theft and present it to whatever court I end up at. I'm hoping that several or more court cases like mine might get a local ruling that will strengthen our State case.

I have asked NMA and WOHVA to make these stickers available at local events for a minimum donation of $25. And I understand that anyone who sends in a donation or has already done so will receive the appropriate number of stickers. If NMA agrees with my multiple bike rule, some of you that have already donated may want to notify them if you have more than one bike and have donated at least the same multiples of $25... or what the heck, send in a little more :smirk:

In my way of looking at this situation:

I know for a fact that the ORV TAB portion of the NOVA funds was a self-imposed fee that the ORV users agreed to. It was not a State Ruling to impose the fee, we agreed to it and even increased it recently to help our fund. By Law, that money can only be used for ORV (or off-road) purposes along with the Gas Tax Refund money. We waived our right to claim that tax refund too.. Make no mistake, that is a REFUND, just like your Federal Income Tax REFUND that they are confiscating. None of this is State Money to begin with! See the point?

The State Legislature is breaking the law!!! Do I condone that? H... NO!! If I cave in and continue to pay a TAB fee, am I NOT aiding and abetting the State's lawless action? I THINK SO!! And I refuse to do that!

There! a lot shorter than the other post.. whew! :D

Joe

:thumbsup: Will do, but I think Byron and Tod will know before me as I believe they are being shipped to WOHVA.

Hopefully some of the Washington Motorcycle Dealers will carry them and collect the donations for us.

Let me remind you that I too will use my stickers as an ORV TAB replacement, but NMA and WOHVA want to remind me and everyone that that is NOT the intended purpose of the stickers.

I think it's going to be fun to meet up with any of you that happen to have one of these support stickers on your bike for a chat or just a wave.

I talked to Adrian at LewisportUSA and he said he threw in even more than 500 at no extra cost. He had some that he thought were cut a little too deep but sent them free of charge. It doesn't affect the sticker any.

Can you believe that he did the final artwork adjustments and added rounded corners so they would stay on better and still only charged $117 for 500, then threw the extras in too??

I know he spent most of one day producing them. The guy will bend over backwards to help when it comes to off-road users and that's not limited to Trials People. :worthy:

And if anyone here happens to know TT member Laser17 over at the Trials Forum, you can thank him for doing the art-work for free. :worthy:

2PLY- I agree with you 100%! I am fighting to get the NOVA fund back and doing alot of other things to promote and further our sport. I do not think you or anyone else is wrong for not buying tabs

It is total crap what the State did. They miss understand their power as legislators- just because something passes with majority votes does not mean it is legal or within their right or power to impose it upon the citizens of WA- ergo the lawsuit.

I understand and I don't fault anyone for paying the tabs. However, in my case, I'm prepared to take the time off work to make a court appearance in order to present my defense and get as much of the facts documented as I can. I'm hoping others are prepared to do the same but I'm not going to let that influence my decision. I can afford the time and expense of doing that. It may or may not work, but it will certainly NOT work if I just pay the fine and don't challenge it.

I wonder how many such court cases it will take to get noticed. It's worth a try.

Plus, I understand that ANY fine I pay DOES NOT GO BACK TO THE STATE. It goes to a "victim's fund" if it's on USFS ground and back to the counties if it's on DNR land. Correct me please if I'm wrong.

Oh I have not given up on the fight at all. Fact is Capitol Forest is a joke now and I do not find myself having fun on the quad rut trails there. Tahuya has no place for me to camp any more that I want to camp at, if you never had a chance to stay at Twin Lakes you missed a great spot. Twin Lakes was the only place I have found where I can camp on a lake and go ride. Tahuya was the perfect family get away with trails for all skill levels. I know how DNR works and this is just the beginning. We are seeing just the tip of the spear. Many things will get shut down due to the NOVA fund theft over the next two years. At the end of the two years I doubt the state will let go of that money and return it to where it belongs. The lawsuit is our only hope, that I am sure of. My home state makes me ashamed with it's actions of theft and mismanagement. Year after year we get beat down with laws that strip us of our freedom and continue to forge our state into a socialist society. I guess you could say I am about as pissed off at my elected officials as I ever have been in my life. All I want to do is go ride my dirtbike with family and friends without the state fing it up!
Joe........

Joe. I know you've worked hard (harder then lots of folks) keeping riding areas open and fighting the good fight, so my comments where not strictly directed towards you, but more to the attitude that some might take that it's too late, and that we have lost the battle.

This thread started on the premise that not buying ORV tabs will somehow make a difference.. maybe it will, but in the end, all it's likely going to do is give those that are withholding their fees a sense of sticking it to the man.. which can feel good - for a while but that doesn't really help our cause as much as letting the people know that make these decisions with a LOUD, respectful, but constant voice that we are not going to accept being shut out of our public lands - at least not without a fight.

"A society of sheep must in time beget a government of wolves."

EDIT: props to 2Ply and others that are actually doing something more besides just withholding their tab fees..

This is an example of someone that thinks instead of just poring out emotion,I agree. holding back your tabs is so going to damage us in the long run and as in the pastsometimes that damage will not get fixed. The feds in1985 decided to afix a lux tax on boats over 200k. Boat cos shut down sales stopped it was a mess. one year later Foley turned it around.BUT the cos that shut down never returned. We are faceing the same thing here once our count is lost we will just keep loseing.

Not only will I not buy a single ORV tab for the 2010 year, I will not pay the extra $5 for parks also for atleast this year, more likely, more than that even. I have a road plated KTM which will mean I can still ride trails.
