Yakima county anti-ORV reg?

Anyone know any particulars of a Yakima county ordinance that forbids ORV "facilities"on private property, and defines facility as more then two tracks of an ORV? I heard about it this Saturday in Yakima.
Supposedly it has nothing to do with sound or dust, only needing a complaint and visual evidence. I was told it only requires two passes over the same path to constitute a facility. I'm having a hard time believing this could survive a court challenge.:rant:

yes it is true any property that is zoned agg can not have a track of any type the way it is written. Several people are fighting Steve Maeir had to flatten his MX track before the county would give him a building permit. The county employee(I forget his name but I will him Bob) is a horse guy and has a beef with any thing motorized, several RC car tracks have been shut down.
Bob will not issue tickets because then a Judge would decide if this was just or not. Bob just uses intimidation to close the tracks. Alot of people just give Bob the number one finger. Several people rack there track after each use so there is no evidence.
The President of the Dust Dodgers knows more about it since he researched it so he could buy land to put a track on.

I learned a little more about the Anti ORV rule tonight. Steve Agnew came to A Dust Dodgers meeting tonight looking for help to rewrite the law and present it to the county. Steve started a petion to get the law changed and passed it around to all the shops and got enough signitures.
Steve got a notice of non compliance from the county post on his property and one sent certified mail. He has the support of at least one county council person. The county code enforcer is name John Brackenhower or something close to that.

I didn't follow that last part....Steve (one of us?) got a letter of no compliance (about his own property?) Is John Brackenhower the good guy or bad guy....

Ugh I need to wake up. :)

This is a take of private property unless the county can show that "Sensitive" environmental resources are substantially degraded from the MX tracks operated on private property.

Are these tracks open to the public on a fee basis? If so, they would've had to comply with SEPA at some point.

Scott, if they try to close you down there will be at least 4 states worth of us standing in a human shield around your most excellent tracks. :worthy:

Steve is the dirt bike rider that was shut down for riding on his own private track. The Letter of non compliance was sent because he was not complying with the zoning Ordinace.
John is the Evil County zoning enforcer that is pushing this way to far.
Several Dirt Bikers at each county council meeting might work.

Kelley, they are not after Eddieville or the Ridge. We are in Klickitat county. I was visiting in a shop in Yakima when I heard about it and felt the word needed to get out. It has to be the worst ORV legislation ever.
In Klickitat county, they just kick the property out of AG designation and send you a $20,000 bill for taxes and penalties. Got that for Eddieville at the first of the month and have been fighting it ever since.:foul:

Well, maybe rig up a small backpack sprayer with nothing in it, tell them the bike is a piece of agricultural or farm implement and you are spraying for tansy ragwort with it. Crazy stuff. If they restrict the use of the land, its considered a "taking" and you must be compensated for it. As for the AG designation, hey, tell them you are tilling (roosting) to plant corn rows for ethanol. :mad: :banghead: You guys need a house cleaning over there in that county!

Some John Deere stickers wouldn't hurt either.
